Notice to Interested Bidders and Service Providers

Metsi Ke Matla Joint Venture (“MKM-JV”) may, from time to time, publish Requests for Proposals (RFP’s), Requests for Quotations (RFQ’s), tender notices and other procurement opportunities issued by subcontractors operating within the project environment. These notices are published for information and enterprise-development purposes only.

By accessing or responding to a procurement notice published on this website and/or on our social media pages, interested parties acknowledge that:

MKM-JV and each subcontractor are separate and independent legal entities.

Unless expressly stated otherwise in writing, the procurement process is conducted and managed solely by the subcontractor identified in the notice. All enquiries, submissions, evaluations, negotiations, appointments, awards and resulting contracts must be handled directly with that subcontractor.

Publication on the MKM-JV website and/or its social media pages does not mean that MKM-JV has endorsed, recommended, nominated, approved or guaranteed any bidder, supplier, service provider, contractor, product or service.

Unless expressly stated otherwise in writing, MKM-JV does not participate in or influence the evaluation, adjudication, selection or appointment of bidders, nor does it manage any contract arising from a subcontractor’s procurement process.

Any contract resulting from a notice published on this website and or social media pages will be concluded directly between the issuing subcontractor and the successful bidder. No contractual relationship, obligation or liability will arise between MKM-JV and any bidder or successful service provider solely because the notice was published on this website and/or social media pages.

Interested parties are responsible for reviewing the applicable procurement documents, confirming all information directly with the issuing subcontractor and conducting their own due diligence before submitting a response or entering into any agreement.

To the fullest extent permitted by law, MKM-JV will not be liable for any loss, damage, cost, claim, dispute, delay or contractual obligation arising from participation in, reliance on, or the outcome of a subcontractor’s procurement process published on this website.

All parties must comply with applicable laws and regulatory requirements, including procurement requirements, confidentiality obligations and the Protection of Personal Information Act 4 of 2013 (“POPIA”).

MKM-JV may publish, correct, amend, suspend or remove a procurement notice from its website at any time. Interested parties should confirm deadlines, requirements, amendments and the status of an opportunity directly with the issuing subcontractor.

Where the terms of a specific procurement notice differ from this disclaimer, the terms stated in that notice will apply to the relevant process.
